Welcome to SportsHero (the “Platform”), an online service owned and operated by SportsHero, LLC (“SportsHero,” “we,” “us,” or “our”). By accessing or using the Platform, including creating an account, posting a profile, launching a sponsorship campaign, making a donation, or using any related services (collectively, the “Services”), you agree to be bound by these Terms and Conditions (“Terms”).
1. Acceptance of Terms
These Terms, together with our Privacy Policy, form a legally binding agreement between you and SportsHero. If you do not agree to these Terms, you may not use the Services.
2. Eligibility
- You must be at least 13 years old to create an account or use the Platform.
- If you are under 18 (a “Minor”), a parent or legal guardian must consent to these Terms on your behalf and supervise your use.
- By creating an account or allowing a Minor to use the Services, the parent/guardian agrees to these Terms and assumes full responsibility for the Minor’s actions.
3. Account Registration
- To use certain features, you must create an account with accurate information.
- You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.
- SportsHero reserves the right to suspend or terminate accounts for violations of these Terms or for any other reason at our sole discretion.
4. Athlete Profiles & Sponsorship Campaigns
- Athletes (or their guardians) may create profiles to share their story, sport, goals, and funding needs (e.g., registration fees, equipment, travel, camps).
- You may create sponsorship/donation campaigns with a funding goal and description.
- All content you post (text, photos, videos) must be accurate, lawful, and not infringe third-party rights.
- SportsHero does not guarantee that any campaign will reach its goal or receive any funding.
5. Donations & Payments
- All donations are processed through third-party payment processors (e.g., Stripe, PayPal).
- Donations are voluntary and non-refundable except as required by law or our Refund Policy (if applicable).
- Funds are received into SportsHero’s designated account. We act as the intermediary and are responsible for disbursing funds to the intended athlete/family for approved sports-related expenses.
- You acknowledge that donations are not tax-deductible unless SportsHero is registered as a 501(c)(3) nonprofit (currently we are not). Consult your tax advisor.
- SportsHero may deduct transaction fees, platform fees (if any), and administrative costs before disbursement.
6. Disbursement of Funds
- Funds are disbursed only to the athlete/family associated with the campaign for verified sports-related expenses (registration, gear, travel, camps, coaching).
- SportsHero reserves the right to verify expenses, withhold or return funds, or cancel campaigns if we suspect fraud, misuse, or violation of these Terms.
- Disbursement is at our sole discretion and may take up to 1 business days.
7. User Conduct
You agree not to:
- Post false, misleading, or fraudulent information.
- Harass, impersonate, or solicit others.
- Use the Platform for illegal purposes or to violate any law.
- Attempt to interfere with the Platform’s operation or security.
8. Intellectual Property
- You retain ownership of content you post but grant SportsHero a worldwide, non-exclusive, royalty-free license to use, display, and promote it in connection with the Services.
- All Platform content, logos, and trademarks are owned by SportsHero or its licensors.
9. No Professional Advice SportsHero is a technology platform only. We do not provide financial, legal, or tax advice. All decisions related to donations or use of funds are your responsibility.
10. Limitation of Liability To the fullest extent permitted by law, SportsHero is not liable for any indirect, incidental, consequential, or punitive damages arising from use of the Services. Our total liability shall not exceed the amount you paid us in the past 12 months (if any).
11. Indemnification You agree to indemnify and hold SportsHero harmless from any claims, losses, or damages arising from your use of the Services, your content, or your violation of these Terms.
12. Termination We may suspend or terminate your account or access to the Services at any time, without notice, for any reason, including suspected violation of these Terms.
13. Changes to Terms We may update these Terms at any time. Continued use after changes constitutes acceptance of the new Terms.
14. Governing Law These Terms are governed by the laws of the State of Idaho, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Kootenai County, Idaho.
